Public councils are consultative, advisory, and supervisory authorities formed by ministries or other bodies directly subordinate to the President of the Republic of Kazakhstan; by local government bodies, national managing holdings, national holdings, national companies (hereinafter referred to as subjects of the quasi-public sector), except for state bodies specified in part two of Paragraph 1 of Article 1 of the Law of the Republic of Kazakhstan «On Public Councils» (hereinafter - the Law), together with non-profit organizations, citizens.

The purpose of public councils is to express the views of civil society on socially significant issues.

The tasks of public councils are:

  1. to represent the people’s interests and take into account the people’s opinions when discussing and making decisions on issues at the republican and local levels;
  2. to ensure cooperation between central executive bodies and local government and self-government bodies. To develop cooperation between the subjects of the quasi-public sector and civil society;
  3. to organize public control and ensure transparency of the activities of central executive bodies and bodies of local government and self-government, as well as subjects of the quasi-public sector.

Public councils carry out their activities according to the following principles:

  1. independence;
  2. voluntary activity of its members;
  3. autonomy;
  4. self-sufficiency;
  5. publicity.

Public councils formed by subjects of the quasi-public sector are authorized to:

  1. discuss draft strategies and development plans;
  2. discuss reports on the implementation of strategies and development plans;
  3. discuss results of financial and economic activities;
  4. develop proposals for improving the laws of the Republic of Kazakhstan and submit them to state bodies;
  5. create commissions for their spheres of activity;
  6. approve Regulation on the Public Council;
  7. implementation of public control in the forms provided for by the Law.

Public councils on the republican and local levels are formed by working groups, the leaders of which are elected from among the members of the working groups representing civil society.

The number of representatives from a state body, a subject of the quasi-public sector in a working group may not exceed one third of the total number of members of a working group. The members of representative office are appointed by a head of a state body or a head of an executive body of a subject of the quasi-public sector.

The number of civil society representatives makes up at least two thirds of the total number of members of the working group and is formed on the basis of applications from non-profit organizations and citizens.

The composition of the working group at the republican level is approved by a head of a relevant state body, a head of an executive body of the subject of the quasi-public sector; at the local level – by a secretary of the Maslikhat of the corresponding administrative-territorial unit.

By order of the Chairman of the Management Board of Baiterek National Management Holding JSC (hereinafter – the Holding) No. 63-B dated June 28, 2021, the following members of the group working on the formation of the Holding’s Public Council were appointed:

  1. Makasheva A.Zh. Civil Society Representative, Head of the Working Group;
  2. Mitrofanova E.N. Civil Society Representative, a member of the Working Group;
  3. Amerkeshev R.B. Civil Society Representative, a member of the Working Group;
  4. Zhumabay A.E. Civil Society Representative, a member of the Working Group;
  5. Karlygashev A.K. Civil Society Representative, a member of the Working Group;
  6. Shamshin A.N. The Holding’s Managing Director, a member of the Working Group;
  7. Murzagalieva A.E. Director of the Asset Management Department of Baiterek Holding, a member of the Working Group.

On June 24, 2021, the first meeting of the group working on the formation of the Holding’s Public Council (hereinafter referred to as the Working Group) was held via video conference.

At this meeting, 4 issues of the agenda were discussed:

  1. Selection of members of the Working Group.
  2. Election of the head of the Working Group.
  3. Determination of the number of members of the Public Council.
  4. Informing the people of Kazakhstan about the competition for the election of members of the Public Council.

The Working Group made the following decisions:

On the first issue, it was decided:

To appoint the following members of the Working Group:

  1. Shamshin Arman Nurzhanovich – a representative of Baiterek Holding;
  2. Murzagalieva Aliya Erbolatkyzy – a representative of Baiterek Holding;
  3. Mitrofanova Elena Nikolaevna – a representative of civil society;
  4. Amerkeshev Rustem Bolatbekovich – a representative of civil society;
  5. Zhumabay Almaz Erbolatovich – a representative of civil society;
  6. Karlygashev Azamat Kairatovich – a representative of civil society;
  7. Makasheva Anar Zhanarovna – a representative of civil society.

On the second issue, it was decided:

To elect Anar Zhanarovna Makasheva as the head of the Working Group.

On the third issue, it was decided:

To elect the 11 members of Baiterek Holding’s Public Council.

On the fourth issue, it was decided:

That the Working Group shall publish an announcement on the competition for the election of members of Baiterek Holding’s Public Council in the media and (or) the Holding’s website and social media pages. The Working Group shall also organize the election of members of the Holding’s Public Council.
